When to recalculate your alimony?

Alimony amounts are often fixed for extended periods. However, quite a lot can change during that period and there may be several reasons to have your alimony recalculated. These can be financial reasons, but also changed personal circumstances, with yourself or your ex-partner. For example:

  • a new job or promotion
  • a bonus or profit distribution
  • additional tax surcharges received
  • resign
  • long-term absenteeism that reduces income
  • fluctuating income as a self-employed or entrepreneur
  • changes in the tax system
  • new laws and regulations
  • Any (additional) income from abroad
  • pension
  • higher housing costs, such as significantly higher energy bills
  • changes in living situation, such as a move
  • changes in access arrangements
  • changes in family composition, such as living together again* or adding a child

* This applies to the alimony obligor. If you, as the alimony obligee, remarry, enter into a registered partnership or cohabit “as if you were married,” the alimony obligation stops altogether.

Alimony modification

Does the recalculation show that the alimony amount needs to be adjusted? Then you can make arrangements with your ex-partner. Does your ex-partner not cooperate or are you unable to reach a mutual agreement? Then you can ask the court to determine a new alimony amount.

Non-modification clause

Does the divorce agreement have a non-amendment clause? This means that the amount of alimony normally cannot be changed. But if there are significant changes in your situation, sometimes the amount can still be adjusted. This can only be done if it is unreasonable to continue following the non-amendment clause.
