an accountant is often brought in for this purpose.<\/li>\n\n\n\n<li>The fluctuating income of a freelancer requires a specific approach when calculating Alimony.<\/li>\n\n\n\n<li>Freelancers generally build up less pension; The business value is determined and included in the division of assets. The starting point is that the business can be continued after the divorce.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nuptial agreements<\/h3>\n\n\n\n<p>With a prenuptial agreement, the sole proprietorship may be excluded from the community. Please note: a periodic set-off clause that has not been complied with annually can still create a settlement obligation. <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_is_a_sole_proprietorship_valued\"><\/span>How is a sole proprietorship valued?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The valuation of a sole proprietorship depends on the nature of the business, the turnover, the results, and the existing goodwill. In many cases, an accountant is hired to determine the value. Key points of attention include:  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The extent to which the turnover is personal\u2014goodwill that is not transferable often does not count towards the valuation.<\/li>\n\n\n\n<li>Investments in business assets made during the marriage using communal assets.<\/li>\n\n\n\n<li>The question of whether the business remains financially viable after the buyout.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Alimony_for_a_freelancer\"><\/span>Alimony for a freelancer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The calculation of <a href=\"https:\/\/simmelink.nl\/en\/family-law\/alimony\/\">Alimony<\/a> for a freelancer differs from that of an employee. A freelancer&#8217;s income can vary from year to year and even month to month. Usually, an average is taken over several years based on the annual accounts. If you have built up a pension during the marriage, equalization generally applies: the ex-partner is entitled to half of the pension built up during the marriage.
