The X registration is legally available to individuals who no longer identify as male or female, such as non-binary or intersex persons.  <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block s-padding-vert-m sim-content-block\">\n<h2 class=\"gb-text\"><span class=\"ez-toc-section\" id=\"What_does_an_X_in_your_passport_or_identity_card_mean\"><\/span>What does an X in your passport or identity card mean?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An X in your passport is seen as a gender-neutral alternative to the traditional gender designation. More and more people are consciously choosing this form of registration, especially among non-binary individuals who do not identify with the traditional male\/female categories. What is stated in your passport will then no longer have a label that does not fit who you are.    <\/p>\n\n\n\n<p>Since 2022, you can choose an X instead of M (male) or V (female) on your passport and identity card in the Netherlands. This option is intended for people who do not (fully) identify as male or female. After the court&#8217;s approval, your gender registration will be updated in the Personal Records Database (BRP) and at the civil registry. With an X registration, you will receive a travel document that better aligns with who you are. Consequently, what is stated in your passport will better reflect your true identity.    <\/p>\n\n\n\n<p>An X in your passport stands for registration as &#8220;gender undetermined.&#8221; This term is consciously chosen in birth certificates, passports, and court rulings because it allows room for personal experience without imposing a judgment. <\/p>\n\n\n\n<p>For many people who do not identify as male or female \u2013 such as non-binary or intersex persons \u2013 this is an important form of recognition.<\/p>\n<\/div>\n\n\n\n<div class=\"s-padding-vert-m\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_there_a_legal_regulation_for_X_registration\"><\/span>Is there a legal regulation for X registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the Netherlands, there is no explicit legal regulation for X registration (yet). The court handles the application as a civil petition procedure based on the Code of Civil Procedure. In practice, the court often applies <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0002656&#038;boek=1&#038;titeldeel=4&#038;afdeling=13&#038;artikel=28&#038;z=2024-01-01&#038;g=2024-01-01\">Articles 1:28 to 1:28c of the Dutch Civil Code<\/a>. These provisions were originally intended for gender reassignment from male to female (or vice versa), but they also form the legal basis for an X request.   <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block s-padding-vert-m sim-content-block\">\n<h2 class=\"gb-text\"><span class=\"ez-toc-section\" id=\"When_are_you_eligible_for_an_X\"><\/span>When are you eligible for an X?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Whether you are eligible for a gender-neutral gender registration depends on your personal situation and how you identify. Case law in this area is constantly evolving. Choosing an X in your passport instead of M or V is not yet regulated by Dutch law.  <\/p>\n\n\n\n<p>An X registration is only possible if you structurally do not identify as male or female. The court assesses whether your request is sufficiently substantiated. This assessment differs from requests by persons who identify with the opposite gender.  <\/p>\n\n\n\n<p>In the case of an X registration, the focus is not on a transition to the other gender, but on the absence of a binary identity. Non-binary persons fall outside the traditional classification. You do not need to have had any medical treatment. However, an expert statement is mandatory, stating that your gender identity is non-binary. This amount consists of: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u20ac341 court fees (court costs in 2025)<\/li>\n\n\n\n<li>\u20ac719 legal preparation and guidance<\/li>\n\n\n\n<li>No additional lawyer fees, unless the court schedules a hearing<\/li>\n<\/ul>\n\n\n\n<p>If the court schedules a hearing, we will charge additional costs for the extra time investment. We can inform you about the amount of the personal contribution and how it is determined.   <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Combining a name change with an X application<\/h3>\n\n\n\n<p>Would you like to <strong>change your first name at the same time<\/strong>? That is possible.<br\/>For a separate name change, we charge <strong>\u20ac960<\/strong>, but with a <strong>simultaneous application<\/strong>, we can combine the procedures efficiently. As a result, you pay <strong>\u20ac1,060<\/strong> for both together, instead of two separate processes of \u20ac960 and \u20ac1,060.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Possibility of subsidized legal aid<\/h3>\n\n\n\n<p>If your income and assets are below a certain threshold, you may be able to use a grant via the Legal Aid Board.
