This differs from procedures for adults, where the compelling reason is linked only to the petitioner themselves; for minors, both the position of the parent making the request and the position of the child are weighed. <\/p>\n\n\n\n<p>In practice, three factors consistently recur in this type of request:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The nature of the compelling reason from the child&#8217;s perspective. In practice, judges usually weigh whether the change is primarily motivated by the child&#8217;s interests (bullying, identity issues, painful memories of an absent or harmful parent), or mainly by the interests of the parent submitting the request. A child-centered motivation is usually given significant weight in Simmelink files.  <\/li>\n\n\n\n<li>Actual use of the new name in daily life. Existing use at school, at sports clubs, with family members, or in care relationships significantly strengthens the motivation. If the desired name is not yet being used in practice, a more detailed personal substantiation is required in the petition.  <\/li>\n\n\n\n<li>Consent of both custodial parents, or consistency between the child&#8217;s wishes and the parents&#8217; motivation. In cases of joint custody, joint consent is the starting point; in the event of a difference of opinion, the assessment usually considers the reasonableness of the refusal and, for children aged twelve or older, the child&#8217;s own wishes. <\/li>\n<\/ul>\n\n\n\n<p>When these three factors are sufficiently met and the desired name complies with birth certificate requirements, approval is feasible in most cases. If you have doubts about the feasibility in your situation, you can have your case assessed in a consultation before the petition is drafted. <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_legal_aspects_of_a_childs_first_name_change\"><\/span>What are the legal aspects of a child&#8217;s first name change?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The legal basis for a first name change is found in <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0002656&amp;boek=1&amp;titeldeel=1&amp;artikel=4\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Art. 1:4 of the Dutch Civil Code<\/a>. The court can order a change, addition, or deletion of a first name when the petitioner demonstrates a compelling reason. For minors, the judge additionally assesses the best interests of the child; this two-pronged test is characteristic of proceedings involving children.  <\/p>\n\n\n\n<p>Four characteristics distinguish the procedure for minors in practice.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Two-pronged test: compelling reason AND the best interests of the child<\/h3>\n\n\n\n<p>For adults, the focus is on the compelling reason for the petitioner themselves. For minors, the emphasis shifts: in practice, judges usually first assess whether the change is in the child&#8217;s best interests, and then whether the grounds themselves have sufficient weight. A change that primarily serves a parent&#8217;s interest and does not demonstrably benefit the child is usually rejected in practice.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Substituted consent upon refusal by the other parent<\/h3>\n\n\n\n<p>When custodial parents disagree on the change, the consenting parent can ask the court to grant substitute consent based on <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0002656&amp;boek=1&amp;titeldeel=14&amp;afdeling=1&amp;artikel=253a\">Art. 1:253a of the Dutch Civil Code<\/a>. The judge assesses whether the other parent&#8217;s refusal is unreasonable, given all circumstances. In Simmelink files, we generally see that the nature of the objections, the best interests of the child, and the stability of the family situation come into play in that assessment.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The child&#8217;s right to be heard<\/h3>\n\n\n\n<p>From the age of twelve, the child must be heard based on <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0001827&amp;boek=3&amp;titeldeel=6&amp;afdeling=2&amp;artikel=809\">Art. 809 of the Code of Civil Procedure<\/a>. The judge invites the child for a conversation. From approximately eight years old, the judge may invite the child, depending on the nature of the request and the child&#8217;s maturity. The conversation takes place without the parents present, so the child can speak freely. The child&#8217;s opinion is not binding but carries significant weight from the age of twelve.    <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Evidence that carries weight in files<\/h3>\n\n\n\n<p>In files involving bullying, school documentation and any statements from practitioners are usually included. For identity-related requests, statements from practitioners or counselors carry weight. In requests where the name refers to a family member with whom the relationship is strained, documentation of the nature and course of that relationship is important. In files where the other parent refuses, written documentation of that parent&#8217;s position and previous attempts at consultation is significant.   <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Examples_from_our_Practice\"><\/span>Examples from our Practice<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The examples below are anonymized and compiled from multiple cases in our practice. Outcomes are not mentioned. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Bullying at school as a compelling reason<\/h3>\n\n\n\n<p>A nine-year-old child was systematically bullied at school because of their first name, which led to undesirable puns in Dutch. The petition was supported by statements from the school management and a practitioner treating the child, as well as a short written motivation from the child themselves. The alternative name was already being used in practice at school by teachers and classmates. The father refused to cooperate. Prior to the petition, the father was asked for consent in writing, with substantiation and a reasonable response period. In the absence of agreement, substitute consent was requested based on <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0002656&amp;boek=1&amp;titeldeel=14&amp;afdeling=1&amp;artikel=253a\">Art. 1:253a of the Dutch Civil Code<\/a>; the motivation combined the nature of the naming with the child&#8217;s interest in having a name without that association.   <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Addition of a second first name before the school period<\/h3>\n\n\n\n<p>Parents wished to add a second first name for their youngest child, aged three, to name them after a grandparent. Both parents agreed. The petition was submitted prior to the start of primary school to limit administrative traces later on. The motivation combined the family interest with the choice of timing. The child was fourteen years old at the time of submission and was heard by the judge based on <a href=\"https:\/\/wetten.overheid.nl\/jci1.3:c:BWBR0001827&amp;boek=3&amp;titeldeel=6&amp;afdeling=2&amp;artikel=809\">Art. 809 of the Code of Civil Procedure<\/a>. The motivation combined the child&#8217;s own wishes with the actual use of the new name in the school environment. Furthermore, in files with conflicting parents, we more often see that written documentation of the consultation prior to submission strengthens the position in an Article 1:253a Civil Code request. <\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_does_the_procedure_work_step-by-step\"><\/span>How does the procedure work step-by-step?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedure takes place via a petition to the court, submitted by a lawyer. We guide you through every step. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consultation or intake interview. <br\/>We discuss your situation, the age and position of the child, the role of the other parent, and what substantiation is already available. You will receive an assessment of the feasibility and a clear cost overview. In the event of a difference of opinion between parents, we also discuss whether a written preliminary round or mediation is appropriate.  <\/li>\n\n\n\n<li>Strategic choices in advance. <br\/>Two choices determine the structure of the file. First: addition or replacement. Addition is procedurally lighter and suits a tribute or cultural motive; replacement requires stronger substantiation and suits situations where the existing name itself is burdensome. Second: in the event of a difference of opinion between parents, you choose between written consultation in advance or a direct request for substitute consent. We discuss these choices before the petition is drafted.    <\/li>\n\n\n\n<li>Collection of documents. <br\/>We help you organize the necessary documents: a recent birth certificate, an extract from the Personal Records Database (BRP), valid identification for both parents who have custody, and the substantive substantiation (statements from school, a practitioner or counselor, proof of actual use, the child&#8217;s own written motivation if of sufficient age). In cases of joint custody, written consent from the other parent is required, or a substantiation for its absence. <\/li>\n\n\n\n<li>Drafting the petition. <br\/>The lawyer drafts the petition with the legal basis (Article 1:4 of the Dutch Civil Code, possibly Article 1:253a of the Dutch Civil Code), the compelling reason, the best interests of the child, and the desired name. For children aged twelve or older, the child&#8217;s own motivation is mentioned or attached. <\/li>\n\n\n\n<li>Submission to the court. <br\/>We submit the request to the court in your place of residence. In the case of a substitute consent request, an oral hearing is more frequently scheduled. For children aged twelve or older, the court summons the child for a conversation.  <\/li>\n\n\n\n<li>Court order and waiting period. <br\/>The court issues a ruling. If granted, a three-month appeal period applies, during which the other parent or an interested party can appeal. After that period, the change is final.  <\/li>\n\n\n\n<li>Processing in the BRP and official documents. <br\/>The change is added as a subsequent mention to the birth certificate and registered in the Personal Records Database (BRP). After that, the passport, identity card, school registration, and healthcare registrations can be updated. <\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_much_does_a_first_name_change_for_a_child_cost\"><\/span>How much does a first name change for a child cost?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The total costs are known in advance and fixed: \u20ac899. The lawyer fee is \u20ac558 including VAT; the court fee is \u20ac341. We work with a fixed price agreement in advance, without hourly rate billing afterwards. The lawyer fee is the same for requests for yourself and on behalf of minors, and the same for adding, changing, or deleting names.   <\/p>\n\n\n\n<p>When an oral hearing is scheduled\u2014more common in substitute consent requests than in joint requests\u2014we discuss the additional costs for preparation and attendance in advance, before the hearing is confirmed. The judge assesses whether the refusal is unreasonable, given all circumstances. Three points of attention in this type of case:  <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Written consultation before submission. <br\/>A written request to the other parent with substantiation for the change and a reasonable response period strengthens the position. In the absence of agreement, this documentation forms a factual basis for the judge&#8217;s reasonableness assessment. <\/li>\n\n\n\n<li>Substantive weighing by the judge. <br\/>In practice, this weighing usually considers the nature of the objecting parent&#8217;s objections, the nature of the compelling reason for the child, the stability of the family situation and, from the age of twelve, the child&#8217;s own wishes.<\/li>\n\n\n\n<li>Mediation as an alternative. <br\/>In situations where the objections allow room for consultation, mediation may be a more appropriate route than legal proceedings.
