The court often assesses whether that change is structural and affects the financial capacity or need. <\/p>\n\n\n\n<p>Depending on the circumstances, recalculation can take place via:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Consultation or mediation<\/strong> \u2013 parties adjust agreements in consultation<\/li>\n\n\n\n<li><strong>A lawyer-led procedure<\/strong> \u2013 if there is no agreement<\/li>\n\n\n\n<li><strong>Petition to the court<\/strong> \u2013 in case of a modification of a court ruling<\/li>\n<\/ul>\n\n\n\n<p>In international situations, the question of which court has jurisdiction and which law applies (Brussels II-ter) also plays a role.<\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Changing_spousal_maintenance\"><\/span>Changing spousal maintenance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A modification of <strong>partner alimony<\/strong> often arises in the case of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an increase or decrease in income of one of the former partners<\/li>\n\n\n\n<li>cohabitation or remarriage of the maintenance creditor<\/li>\n\n\n\n<li>reaching the maximum term (usually twelve years)<\/li>\n<\/ul>\n\n\n\n<p>The court assesses whether the modification is reasonable and whether it fits the legal standards of need and financial capacity.<\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Changing_child_support\"><\/span>Changing child support<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With <strong>child alimony<\/strong>, the best interests of the child are central.<br\/>A modification is possible if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the division of care or visitation arrangement changes<\/li>\n\n\n\n<li>the income of (one of) the parents changes<\/li>\n\n\n\n<li>the costs of living or childcare change<\/li>\n<\/ul>\n\n\n\n<p>In many cases, the court looks at current standards (Trema standards) to determine a balanced contribution.<\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedural_steps_for_a_modification_request\"><\/span>Procedural steps for a modification request<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">1. Consultation or recalculation<\/h3>\n\n\n\n<p>Parties can have a new calculation made together \u2013 whether or not with a lawyer or mediator.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Decrease in income after dismissal<\/strong><br\/>A client lost his job and could no longer pay the established partner alimony. Change in division of care<\/strong><br\/>After a change in co-parenting, a parent wanted to have the child alimony adjusted.
