the deceased or heirs have a connection with more than one country.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In many cases involving an estate with international elements, the European Succession Regulation (EU 650\/2012) determines which law applies and which court has jurisdiction.<\/li>\n\n\n\n<li>The starting point is the law of the country where the deceased had their habitual residence at the time of death.<\/li>\n\n\n\n<li>A deceased person may choose the law of their nationality in a will \u2014 this is known as a choice of law.<\/li>\n\n\n\n<li>For real estate located abroad, additional rules apply that may deviate from the general rules of jurisdiction.<\/li>\n\n\n\n<li>Depending on the circumstances, there may be a concurrence of multiple legal systems, which makes the apply?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>International inheritance law applies as soon as an estate contains a cross-border element. In practice, this often involves situations where: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The deceased lived or worked abroad.<\/li>\n\n\n\n<li>Heirs live in different countries.<\/li>\n\n\n\n<li>Assets, such as a home or bank account, are located abroad.<\/li>\n\n\n\n<li>De overledene meerdere nationaliteiten had.<\/li>\n<\/ul>\n\n\n\n<p>Het internationale karakter van een zaak bepaalt niet alleen welk recht van toepassing is, maar ook voor welke rechtbank een procedure eventueel wordt gevoerd.<\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_law_applies_to_an_international_estate\"><\/span>Which law applies to an international estate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Within the European Union, the applicability of law to estates is governed by the European Succession Regulation (EU 650\/2012), also known as the Succession Regulation. This regulation applies to estates of persons who died on or after August 17, 2015. <\/p>\n\n\n\n<p>Depending on the circumstances, there are three starting points:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Habitual residence<\/strong><br\/>The general rule is the law of the country where the deceased had their habitual residence at the time of death. This is not always the country of nationality. <\/li>\n\n\n\n<li><strong>Choice of law<\/strong><br\/>A deceased person can choose the law of their nationality in a will. This choice must be expressly recorded. <\/li>\n\n\n\n<li><strong>Exception for real estate<\/strong> <br\/>Additional rules may apply to real estate. In some countries, certain aspects of the inheritance of real estate are governed by the law of the place where the property is situated. <\/li>\n<\/ol>\n\n\n\n<p>For estates with a connection outside the EU, for example in the United States, the United Kingdom, or Australia, different conflict-of-law rules apply and a tailored approach is required.<\/p>\n<\/div>\n\n\n\n<div class=\"s-content-block\">\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_court_has_jurisdiction_in_an_international_estate\"><\/span>Which court has jurisdiction in an international estate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The European Succession Regulation also determines the international jurisdiction of the court. In principle, the courts of the country where the deceased had their habitual residence at the time of death have jurisdiction. <\/p>\n\n\n\n<p>Depending on the circumstances, this may be deviated from, for example, when the deceased has made a choice of law for the law of their nationality. Determining which law prevails is then a first step. <\/li>\n\n\n\n<li><strong>Distribution of assets abroad<\/strong> <br\/>The distribution of a home, bank account, or business abroad often requires separate steps per country.<\/li>\n\n\n\n<li><strong>Recognition of a Dutch judgment<\/strong> <br\/>A judgment rendered by a Dutch court or a European Certificate of Succession can be used in other EU member states.
