Situation – International divorce in the Netherlands

Lukas, an Austrian, and Elise, a Norwegian, married in Austria and later settled in the Netherlands. Due to differences in lifestyle, they decided to divorce, with their joint assets in the Netherlands, Norway, and Austria presenting an additional challenge.

Challenge – Legal requirements for foreign nationalities

Lukas and Elise each held a foreign nationality, which complicated the divorce due to different rules and requirements. Their assets were spread across multiple countries, and the divorce had to be recognized under EU law (Brussels II-ter) and in Norway, their home country. This made it necessary to properly document and legally substantiate the divorce to obtain recognition in all countries involved.

Solution – Support with Joint Petition

We advised Lukas and Elise on their options and assisted with filing a joint petition in the Netherlands. By providing the correct documentation and translations, we prevented additional legal proceedings in Austria, and the divorce could also be registered in Norway.

Result – Recognition of divorce in multiple countries

The divorce was recognized in the Netherlands and formalized in Austria without additional steps. Elise was able to have the ruling registered in Norway with a translation, and both parties divided their joint assets fairly.

Key learnings

This case demonstrates the complexity of international divorces and underscores the importance of legal guidance in divorces involving multiple nationalities. Thanks to a careful approach, Lukas and Elise’s divorce proceeded smoothly, despite international regulations and asset distributions.
